Who is an Apartment Manager and How is He Selected?

The apartment manager is the person responsible for the daily operation of the apartment or site, determined by the joint decisions of the flat owners and within the legal framework. This task can be undertaken by a professional management company or selected from among the flat owners. 

In accordance with Article 34 of the Condominium Law No. 634, it is mandatory to appoint a manager in buildings with eight or more independent sections. Determining the term of office and clarifying the manager's areas of authority are important steps in terms of the responsibilities of the apartment management.

The election of the manager is carried out at the general assembly meetings. In this process, the quorum for participation must be ensured and the decisions taken must be recorded in writing. Flat owners can choose someone from among themselves or appoint a professional person from outside as a manager. Transparency in the election process prevents possible disputes in the future and creates an environment of trust.

Legal Position of the Manager within the Framework of Condominium Ownership

The Condominium Law No. 634 constitutes the basic legal basis for the duties and powers of the apartment manager. According to the law, the manager is appointed by the joint decision of the flat owners or elected by the decision of the general assembly. 

The term of office may be determined for one year or longer, as specified in the management plan or depending on the decision of the general assembly. If all independent sections of the main real estate are owned by a single person, the owner is legally the manager. In accordance with Article 38 of the Law, the manager is responsible to the flat owners just like a representative. Otherwise, he may be held responsible and dismissed by the flat owners and legal authorities.

What are the Basic Duties of Apartment Management?

The duties of an apartment manager range widely and are generally divided into categories such as management of common areas, financial affairs, and legal representation. Correct performance of each of these tasks directly affects the quality of apartment life.

Maintenance and Management of Common Areas

Common area management is one of the apartment manager's most visible responsibilities. Article 35 of the Condominium Law obliges the manager to take the necessary measures for the proper use, protection, maintenance and repair of the main real estate. 

The activities carried out in this context are diverse and ensure the sustainability of the physical infrastructure of the apartment building:

  • Organizing and supervising the regular cleaning of common areas such as apartment entrances, stair landings and corridors.

  • Planning and monitoring the maintenance programs of common technical equipment such as elevators, heating systems and generators. 

  • In order to ensure the safe operation of the elevators in the main real estate, monthly maintenance and annual checks are carried out in accordance with the relevant technical regulations and the fees for these operations are paid.

  • Carrying out periodic checks of common plumbing, electrical infrastructure and other technical systems.

  • Coordination of maintenance and landscaping arrangements for outdoor spaces such as gardens, parking lots and sports fields.

  • Assignment and performance monitoring of security personnel, cleaning staff and other service providers.

Dues Collection and Financial Management

Financial management is one of the most sensitive issues among the duties of the apartment manager. It is the manager's responsibility to collect the determined amount of dues from the flat owners, document these amounts and transfer them to the relevant expense items. Transparency in the apartment dues collection process is important in creating an environment of trust.

When creating the apartment budget, the manager should take into account past period expenses and projected expenses in the future. Regular payment monitoring should be done, reminders should be made for overdue payments and legal follow-up processes should be initiated when necessary. It is mandatory to record all income and expenses in order to inform the audit committee and flat owners.

In accordance with the apartment management plan, it is essential that all expenses be documented and reported regularly. Article 35 of the law obliges the manager to keep all expenses with documentation.

Reporting periods are determined as specified in the management plan or by the decision of the general assembly. Generally, financial statement presentations are made in three-month or six-month periods. 

In accordance with Article 39 of the Law, if half of the flat owners wish, regardless of their land shares, the manager can be asked to show the account outside the times specified in the management plan. Legal Responsibilities and Representation Authority of the Apartment Manager

The legal powers and responsibilities of the manager are determined within the framework of the Condominium Law. The manager is obliged to act in accordance with this legal framework when acting on behalf of the flat owners.

Acting on Behalf of Flat Owners and Litigation Process

The apartment manager has the authority to represent flat owners in legal processes regarding common areas. Clause (i) of Article 35 of the Law gives the manager the authority to file lawsuits and enforcement proceedings against flat owners who do not fulfill their debts and obligations regarding flat ownership. 

The manager may initiate legal procedures in cases such as collecting debts arising from common expenses, filing a lawsuit to protect the common interests of the apartment, or responding to a lawsuit.

However, this power of representation is not unlimited. The manager may exercise his/her authority of representation only on matters related to common areas and common expenses. Individual flat owners do not have the authority to act on matters that fall under their private property. The site administrator's job description is clearly defined in initiating enforcement proceedings, debt collection and court processes, and exceeding these limits may result in legal liability.

Operation in Compliance with the Management Plan and Laws

All transactions of the apartment manager must be carried out in accordance with the provisions of the Condominium Law and the management plan of the apartment. The management plan is the basic document prepared during the establishment of the apartment building and regulating the rights, obligations of flat owners and the rules of use of common areas.

When the manager performs actions contrary to the rules specified in the management plan or neglects his duties, he may be held responsible by the flat owners. He may be dismissed by the decision of the general assembly or face legal sanctions. For this reason, compliance with the management plan stands out as a basic principle among the duties of the apartment manager.

Meetings and Decision Making Process in Apartment Management

The board of flat owners is the most authorized decision-making body of the apartment building and, in accordance with the Flat Ownership Law, makes decisions regarding the management of the main real estate in accordance with the management plan, contract and provisions of the law. 

The manager is obliged to implement the decisions taken by this board and is responsible for the implementation of these decisions in accordance with Article 35 of the law. General assembly meetings are the basic mechanisms where the will of the flat owners is revealed and management processes are shaped.

Ordinary and Extraordinary General Assembly Meetings

The apartment general assembly meeting is the most important mechanism where flat owners come together and make joint decisions. The law divides meetings into two categories: ordinary and extraordinary. 

Both types of meetings are subject to certain procedural rules, and the legal validity of the decisions taken depends on compliance with these rules. Meeting types and their functioning can be summarized as follows:

  • Ordinary general assembly: It is required by law to be held at least once a year. In these meetings, manager selection, budget approval, audit reports are discussed and decisions regarding the next period are taken.

  • Extraordinary general assembly: It meets when urgent issues need to be discussed. It can be organized upon the request of the manager, the board of supervisors or a certain percentage of the flat owners. The need to make quick decisions in extraordinary situations is met.

The meeting call must be notified to the flat owners in writing at least fifteen days in advance. If the quorum for participation is not met, a second meeting is called. A certain majority of votes is required for the decisions taken to be valid.

Decision Book and Registration Obligations

All decisions taken in apartment management must be recorded in a notarized decision book. Article 35 of the Law states that the manager is obliged to write down the protocols, the summary and dates of the warnings and notifications made, and all expenses in the ledger in date order. This book is a legal document and serves to protect the flat owners' right to information. 

The records in the decision book should include the meeting date, participants, topics discussed and decisions taken in detail. It is mandatory for the ledger to be closed by the notary public by the administrator within one month starting from the end of each calendar year.

It is the manager's responsibility to inform all flat owners of the decisions taken. Notification is usually made in writing and is important for the start of the objection period. Transparent record keeping and information are elements that build trust among the duties of the apartment manager. Failure to properly record decisions may result in liability for the manager.

Accountability Obligation of the Apartment Manager

Financial transparency and control mechanisms are indispensable for the healthy functioning of apartment management. Article 39 of the Condominium Law requires the manager to account to the board of flat owners at the times written in the management plan, or if such a time is not written, within the first month of each calendar year. This accountability process is important for trust and transparency among the duties of the apartment manager.

Audit Board Controls and Reports

The audit board formed by the floor owners' board regularly audits the manager's financial transactions and management activities. The audit board reports are presented at the general assembly meetings and ensure that the flat owners are informed.

Audit periods are determined in the management plan and are generally carried out at intervals such as three months or six months. The manager is obliged to meet the demands of the audit board in a timely manner and to submit the necessary documents completely. This process plays a role in preventing corruption and increasing management accountability.

Balance Sheet and Account Transfer at the End of Term of Office

When the manager's term of office expires or he leaves office, the financial statements and documents must be completely transferred to the new manager.
