It is of great importance to determine the cost elements completely in order to calculate tax liabilities accurately in real estate purchase and sale transactions. At this point, one of the most curious issues is the question of what the acquisition price is. The acquisition price forms the basis of the cost incurred to acquire a real estate and plays a decisive role, especially in the calculation of capital gains tax. In addition to the purchase price, some expenses that meet the conditions specified in the legislation may also be included in the acquisition price.

What is the Real Estate Acquisition Fee?

The real estate acquisition fee, in its simplest definition, is the total cost incurred by a person or institution to acquire an asset.  Particularly in the calculation of capital gain within the scope of Article 80 bis of the Income Tax Law, the main element compared with the sales price is the acquisition price. For this reason, the correct calculation of the tax liability arising from the sale of real estate depends on the correct determination of the acquisition price.

In practice, the acquisition price is often confused with the purchase price stated in the title deed. However, in tax applications, this concept may also include expenses incurred to acquire the real estate and allowed to be added to the cost within the scope of the legislation. Which expenses can be included in the acquisition price is evaluated in line with the Income Tax Law, Tax Procedure Law and the guides and rulings published by the Revenue Administration.

Correct determination of the acquisition price is important not only in terms of calculating the tax to be paid, but also in terms of documenting the cost in a possible tax audit. For this reason, keeping invoices, receipts and other official documents related to expenses incurred during the acquisition of real estate helps prevent disputes that may arise in the future.

How is the Real Estate Acquisition Fee Calculated?

The basis for calculating the real estate acquisition fee is the total cost incurred for the acquisition of the real estate. Although the sales price stated in the title deed is taken as basis in the first stage, the calculation is not limited to this. Within the scope of Article 81 of the Income Tax Law, some expenses that meet certain conditions may also be added to the acquisition price. In this way, the real cost of the real estate is revealed and a more accurate calculation of the value increase is provided.

Expenses that can be included in the acquisition price; It is evaluated provided that it is directly linked to the acquisition of the real estate, can be proven with documents and is accepted as a cost element in the tax legislation. For example, the title deed fee paid during the purchase, appraisal fee, notary expenses, and expenses such as renovation and reinforcement that permanently increase the value of the real estate can be added to the acquisition price under certain conditions. On the other hand, routine expenses for maintenance, painting, cleaning or daily use are not considered as cost increasing factors.

Another issue that should be taken into consideration when making the calculation is the Domestic Producer Price Index (D-PPI) indexing. If the conditions in the Income Tax Law are met, the acquisition fee can be increased by taking into account the D-PPI increase rate. This practice aims to determine the taxable income more realistically by taking into account the effect of inflation on cost.

Real Estate Acquisition Fee Calculation Example

Let's assume that a house is purchased in 2026. The costs incurred in this process are as follows:

  • Purchase price of the house: 8,000,000 TL

  • Title deed fee paid by the buyer: 160,000 TL

  • Expertise and other official transaction expenses: 40,000 TL

  • Comprehensive renovation expenses that increase the value of the property: 600,000 TL

In this case, the acquisition price of the real estate is calculated as 8,800,000 TL.

Assuming that the real estate is later sold for 12,500,000 TL, the acquisition fee of 8,800,000 TL is first deducted from the sales price in calculating the capital gain. If the conditions specified in the relevant legislation are met, this amount may also be subject to PPI indexation. Thus, taxable income can be calculated more accurately, taking into account the effect of inflation on costs.

Briefly, we can give the calculation formula as follows:

Acquisition Fee = Purchase Price + Expenses That Can Be Included in the Cost + Value Increasing Expenditures (+ D-PPI Indexing if Conditions Are Met)

In order for this calculation to be made correctly, title deed records, invoices, receipts and other official documents related to the purchasing process must be kept. It should not be forgotten that being able to prove the cost elements with documents in tax audits is one of the determining factors in accepting the acquisition price.

How is the cost determined in cases where there is no acquisition fee?

In some cases, the acquisition price of real estate may not be determined directly. Especially in transactions where there are no documents showing the inheritance, donation (gratuitous transfer) or acquisition price, the determination of the cost is evaluated according to the way the real estate was acquired and the applicable tax legislation.

Since there is no purchase price in the classical sense for real estate acquired through inheritance or donation, capital gains and tax liabilities are handled within the framework of the relevant provisions in the Income Tax Law. For immovable properties acquired through purchase but without cost documentation, title deed records, bank receipts and other official documents may be taken as basis in determining the cost.

Therefore, in cases where the acquisition price cannot be determined, making an evaluation according to the nature of the transaction and obtaining an opinion from a financial advisor or tax expert when necessary helps prevent possible tax disputes.

What Does Acquisition Year Mean in Real Estate Sales?

The year of acquisition refers to the year in which a real estate was legally acquired. In tax applications, this date is used as the basis for determining when the real estate was purchased, the holding period and, in some cases, tax liabilities regarding capital gains.

In practice, the year of acquisition is generally accepted as the year of registration in the land registry. In other words, the date on which the property is registered in the land registry is taken into account, not the date on which the sales contract is signed. In different forms of acquisition such as inheritance, donation or court decision, the year of acquisition is determined according to the legal nature of the transaction.

In real estate sales, accurate cost calculation is as important as the correct price. Complete determination of the acquisition price contributes to both the correct calculation of capital gains and the reduction of possible tax risks. Evaluating current market conditions and analyzing the value of the property with real estate region analysis before making a sales decision can help you manage a more informed sales process.
